Family agreements are presumed to not give rise to any legal obligation,unless the reis evidence to the contrary.
Forinstance,
McGregor v. McGregor (1888) 21 QBD 424: In this case, a husband and a wife withdrew their complaints under an agreement by which the husband promised to pay her an allowance and she promised to refrain from pledging his credit.
Held:This was a binding contract.
Balfour v. Balfour (1919) 2 KB 571: A couple went to England on leave. For health reasons, the wife was unable to accompany the husband again to Ceylon (husband’s workplace).The husband promised to pay 30pounds per month to his wife as maintenance,but he failed to do so. The husband was not held liable as there was no intention to create a legal relationship.
Jones v. Padavatton (1969) 2 ALL ER 616: The daughter, acting on her mother’s promise, left her service and went to another country for education. The mother undertook to foot the expenses. For 5 long years, the daughter could not complete here ducation.Differences arose between them and the mother stopped the payments.It was held that this arrangement did result in a contract, but for a specific period.
Merritt v. Merritt (1970) 2 All ER 760: A separation agreement between estranged spouses was enforceable.
Beswickv.Beswick(1967)AC58:An uncle’s agreement to sell a coal delivery business to his nephew was enforceable.
Errington v. Errington (1952) 1 KB 290: A father promised to pay his son and daughter-in-law that they could live inand ultimately own a house if they paid off the balance of the mortgage,and this was held to be an enforceable contract.
Note:Though family relations are presumed to not give rise to legal relations,this presumption is rebuttable.

Simpkins v. Pays (155) 1 WLR 975: (Newspaper Crossword Case): An informal agreement between a grandmother, grand-daughter and a lodger to share the winnings of the competition was binding as it showed mutuality between the parties.
Connellv.MIB(1969)3ALLER572CA:Lord Denning“I think that when a person regularly gives a lift to another in return for money,there is a contract, albeit in formal.”

जॉन्स बनाम पाड़ावत्तों (१९६९) २ ऑल ई आर ६१६: बेसी ने अपने मा के वादे के कारण अपनी नौकरी छोड़ दी और शिक्षा प्राप्ति हेतु विदेश चली गई। मा ने भी खर्चों का दायित्व उठाया। पाँच सालों में भी बेटी अपनी पढ़ाई पूरी नहीं कर पाई। उनके बीच मतभेद ने घर कर लिया और माँ ने भुगतान रोक दिया। यह माना गया की इस व्यवस्था के फलस्वरूप एक अनुबंध हुआ, पर एक खास अवधि के लिए।
मेरिट बनाम मेरिट (१९७०) २ ऑल ई आर ७६०: अलग हो चुके पति पत्नी के बीच अलगाव समझौता लागू करना असंभव था।
बेसविक बनाम बेसविक (१९६७) ए सी ५८: एक चाचा का अपने भतीजे को कोयला वितरण व्यवसाय बेचने का अनुबंध लागू करने योग्य था।
एरिंगटोन बनाम एरिंगटोन (१९५२) १ के वी २९०: एक पिता ने अपने बेटे और अपने बहु से वादा किया कि अगर वे बंधक की शेष राशि का भुगतान करते है तो वे घर में रह सकते है और आखिरकार घर का मालिक भी बन सकते है और इसे एक लागू करने योग्य संविदा माना गया है।

कोनेल बनाम एम आई बी (१९६९) ३ ऑल ई आर ५७२ सी ए: लॉर्ड देंनिंग “मुझे लगता है कि, जब कोई वयक्ति नियमित रूप से किसी दूसरे वयक्ति को सहायता प्रदान करता है, तो यह औपचारिक रूप से एक अनुबंध होता है।”
व्यवसायिक अनुबंध
वाणिज्यिक समझौतों में वैध अनुबंध की एक धरण है। इन अनुबंधों में जहा पक्ष कुछ इस तरह सौदा करती है जैसे कि वो अजनबी थे, उन्हे अनिवार्य माना जाता है।
