Source text - Arabic أيدت المحكمة الاتحادية العليا حق مطلقة حاضنة لطفلين في زيادة النفقة بعد مرور ست سنوات على إقرارها، مبررة ذلك بارتفاع تكاليف المعيشة وكبر المحضونين وزيادة احتياجاتهما، فضلاً عن زيادة راتب والدهما الذي تزوج بامرأة أخرى.
وقد شرحت لهيئة المحكمة أنها «كانت زوجة المدعى عليه، وأنجبت منه طفلين، وسبق أن فرضت لهما نفقة بموجب حكم»، وتقدم مطلقها بدعوى ضدها طلب فيها تخفيض النفقة المحكوم بها سابقاً وإلغاء تنفيذ حكم بدل السكن وإلغاء أجرة الحاضنة.
قضت محكمة الاستئناف بإلغاء الحكم الأول بشأن ما قضى به بزيادة النفقة والقضاء مجدداً برفض الدعوى بشأنها، وبتأييد الحكم فيما عدا ذلك. ولم ترتض والدة الطفلين بهذا الحكم، فطعنت عليه بطريق النقض، مبينة أن الحكم خالف القانون والشريعة وأخطأ في تطبيقهما وخالف الثابت بالأوراق وأخل بحق الدفاع، وذلك عندما قضى بإلغاء الحكم الأول، القاضي بزيادة النفقة المفروضة سابقاً رغم أن تلك النفقة ثابتة بالأوراق أنه مضى على فرضها أكثر من ست سنوات، وأن تكاليف المعيشة قد ارتفعت وزادت الأسعار وكبر المحضونان وزادت احتياجاتهما.
Translation - English Federal Supreme Court upheld the right of a divorced woman with custody of two children to increase alimony after approving it six years ago, justifying this ruling with the increase of the cost of living, the growing up of children in custody, the increase in their needs, and the raise in their father’s income who married another woman.
She explained to the jury that »she was married to the defendant and had two children with him, and she was previously approved of an alimony by a court’s ruling. «Her divorced husband filed a claim against her to reduce the amount of the alimony previously determined by the court and to revoke the ruling granting housing allowance and payment for custody.
Court of Appeal ruled that the first ruling, which increased the alimony, be revoked, ruled to dismiss the claim for which again, and upheld rulings otherwise. The mother was not satisfied with this ruling, so she appealed on cassation. She explained that the ruling is against the law and shari`a and applied them in a wrong way, went against what was proven by documents and violated the right of the defense, by revoking the first ruling, that upheld increasing the alimony that was previously awarded. This is despite the fact that it was established from the papers that this alimony was awarded more than six years ago and now the cost of living has increased, prices have risen, children in custody have grown up, and their needs have increased.
