1. Contract law in KSA is derived from Shari’ah law principles.
2. It is an important general principle of Shari’ah law that parties must keep to contracts that they have agreed. Parties must respect and implement the principle “Pacta sunt servanda” (the agreement must be kept”.
3. A further important general principle of Shari’ah law stipulates “in principle, all the acts are allowed, unless they are explicitly prohibited”.
4. Parties are generally free to agree whatever contractual terms they consider appropriate unless they are expressly prohibited under Shari’ah law. The binding force of contracts is asserted by jurists of all schools of thought within Islamic jurisprudence and supported by the following sources in Shari’ah law:
(a) “Oh you have believed, fulfil [all] contracts”; and
(b) “Muslims will be held to their conditions, except conditions that cause lawful to become unlawful, or unlawful to become lawful”.
5. Contracting parties must observe and maintain principles of fairness and equity in their dealings.

1. يُستمَد قانون العقود بالمملكة العربية السعودية من مبادئ الشريعة الإسلامية.
2. ينُص أحد المبادئ العامة والهامة للشريعة على ضرورة التزام طرفيّ العقد ببنوده المُتفق عليها فيما بينهما. ويحترم الطرفان مبدأ "العقد شريعة المتعاقدين" ويطبقانه.
3. ينُص مبدأ آخر من المبادئ العامة والهامة للشريعة على أنّ "جميع الأعمال مسموحٌ بها من حيث المبدأ، ما لم تكن مُحرّمة صراحةً".
4. يجوز للطرفين، بوجهٍ عام، الموافقة على أي بنود تعاقدية يريانِها مناسبة، ما لم تُحرِّمها الشريعة الإسلامية صراحةً. ويؤكد فقهاء جميع المدارس الفكرية في الفقه الإسلامي على القوة المُلزِمة للعقود، كما تدعم هذه القوة مصادرُ الشريعة الإسلامية التالية:
)أ ("يا أَيُّهَا الَّذِينَ آمَنُواْ أَوْفُواْ بِالْعُقُودِ"؛
(ب) "المُسْلِمُونَ عَلَى شُرُوطِهِمْ، إِلَّا شَرْطًا حَرَّمَ حَلَالًا، أَوْ أَحَلَّ حَرَامًا".
5. يضع طرفا العقد نصب أعينهما مبادئ العدالة والمساواة في تعاملاتهما ويلتزمان بها.

On rehearing en banc, the Court of Appeals unanimously affirmed the District Court’s dismissal of petitioners’ claims against Mesa.
The en banc Court of Appeals first held that petitioners had failed to state a claim for a violation of the Fourth Amendment because Hernández was “a Mexican citizen who had no ‘significant voluntary connection’ to the United States” and “was on Mexican soil at the time he was shot.” Hernandez v. United States, 785 F. 3d 117, 119 (CA5 2015) (per curiam) (quoting United States v. Verdugo-Urquidez, 494 U. S. 259, 271 (1990)).
As to petitioners’ claim under the Fifth Amendment, the en banc Court of Appeals was “somewhat divided on the question of whether Agent Mesa’s conduct violated the Fifth Amendment,” but was “unanimous” in concluding that Mesa was entitled to qualified immunity. 785 F. 3d, at 120.
The en banc Court of Appeals explained that “[n]o case law in 2010, when this episode occurred, reasonably warned Agent Mesa” that “the general prohibition of excessive force applies where the person injured by a U. S. official standing on U. S. soil is an alien who had no significant voluntary connection to, and was not in, the United States when the incident occurred.” Ibid.

وبعد جلسة إعادة سماع الدعوى أمام كامل الهيئة، أيّدت محكمة الاستئناف بالإجماع حكم محكمة أول درجة برفض مطالب الطاعنين ضد ميسا.
وقضت محكمة الاستئناف بكامل هيئتها أولًا بعجز الطاعنين عن إثبات دعواهما القائمة على انتهاك حقوق التعديل الرابع، حيث إن إرنانديز "مواطن مكسيكي لم يكن له أي 'صلة طوعية تُذكر' بالولايات المتحدة" وكان "على الأراضي المكسيكية وقت إطلاق النار عليه." (قضية "إرنانذيز ضد الولايات المتحدة"، القضية رقم 785، سجل أحكام محكمة الاستئناف الفيدرالية، السلسلة الثالثة، ص 117-119 (محكمة الاستئناف عن الدائرة الخامسة، 2015) (رأي المحكمة بكامل هيئتها) (استنادًا إلى قضية "الولايات المتحدة ضد فرديجو وركيداز"، القضية رقم 494، المحكمة العليا للولايات المتحدة، ص 259-271 (1990))(.
وفي ادعاء الطاعنين انتهاك حقوق التعديل الخامس، "انقسم رأي" محكمة الاستئناف بكامل هيئتها "إلى حدٍّ ما حول ما إذا كان سلوك العميل الفيدرالي ميسا قد انتهك هذه الحقوق بالفعل"، بينما خلصت المحكمة "بالإجماع" إلى أحقية ميسا في الحصانة المؤهلة. وأوضحت محكمة الاستئناف بكامل هيئتها "عدم وجود أي سابقة قضائية - حين وقعت الحادثة عام 2010 - من شأنها تحذير العميل الفيدرالي ميسا التحذير اللازم" من أن "الحظر العام لاستخدام القوة المفرطة ينطبق حين يصيب أحد العملاء الفيدراليين - من على أراضي الولايات المتحدة - أجنبيًا ليس له أي صلة طوعية تُذكر بالولايات المتحدة ولم يكن على أراضيها وقت وقوع الحادثة." • The Economist Intelligence Unit expects that the global economy will contract by 2.5% in 2020 as a result of the coronavirus pandemic. This represents a much deeper global recession than that experienced during the global financial crisis. The negative effect on growth will come via both demand and supply channels. Quarantine measures, illness, and negative consumer and business sentiment will suppress demand, with the closure of some factories and disruption to supply chains creating supply bottlenecks.
• EU leaders are meeting in Brussels this week to discuss the bloc's future budget plans. These negotiations are always challenging, tending to pit net payers against net beneficiaries. There are proposals from the European Commission and the Parliament that some countries think involve spending too much. This time, the talks are further complicated by the departure of the UK, which was a large net contributor.
• It is “still too soon” to say whether the coronavirus outbreak will cause a material change in the U.S. outlook, said Federal Reserve Vice Chairman Richard Clarida, signaling officials won’t be rushed to judgment on the need to cut interest rates. “Monetary policy is in a good place and should continue to support sustained growth, a strong labor market, and inflation returning to our symmetric 2% objective,” Clarida told the National Association for Business Economics in Washington on Tuesday. “As long as incoming information about the economy remains broadly consistent with this outlook, the current stance of monetary policy likely will remain appropriate.”

• تتوقع وحدة المعلومات التابعة لمؤسسة "الإكونوميكس" أن ينكمش الاقتصاد العالمي بنسبة 2.5% عام 2020 جرّاء جائحة فيروس كورونا. وهو ما يمثل ركودًا عالميًا أعمق مما شهده العالم أثناء الأزمة المالية العالمية. كما سيتأثر النمو تأثرًا سلبيًا من خلال قنوات العرض والطلب. ذلك أنّ إجراءات الحجر الصحي، والمرض، والمعنويات السلبية الشائعة بين المستهلكين وفي الأعمال التجارية ستكبح الطلب، علاوة على إغلاق بعض المصانع وتعطيل سلاسل التوريد الذي من شأنه أن يؤدي إلى اختناقات في العرض.

• تؤدي البورصة دورًا مهمًا في الحياة الاقتصادية؛ ومن أهم الوظائف التي تؤديها تنمية الادخار عن طريق تشجيع الاستثمار في الأوراق المالية، وتوجيه المدخرات لخدمة الاقتصاد القومي. فسوق الأوراق المالية تشجع على تنمية عادة الادخار الاستثماري، خاصة بالنسبة لصغار المدخرين الذين لا يستطيعون القيام بمشاريع مستقلة بأموالهم القليلة، ومن ثم فإنهم يفضلون شراء أوراق مالية على قدر أموالهم، وهذا يساعد على خدمة أغراض التنمية والحد من التضخم، كما أنها تساعد على توجيه المدخرات نحو الاستثمارات الملائمة (سواء في الأسهم أو السندات) وذلك وفقًا لاتجاهات الأسعار.

وافقت الحكومة في اجتماعها الأسبوعي اليوم على مشروع قرار رئيس مجلس الوزراء بمشروع قانون بتعديل بعض أحكام قانون الضريبة على الدخل الصادر بالقانون 91 لسنة 2005. وذكرت أن الضريبة على دخل الأشخاص الطبيعيين تعتبر إحدى السياسات الضريبية المهمة لتحقيق العدالة الاجتماعية في توزيع عبء الضريبة وذلك طبقًا لمستويات الدخول وبشكل يحقق العدالة والمساواة.

The government approved, in its weekly meeting today, the Prime Minister's draft resolution on a draft law amending some provisions of the Income Tax Law issued by the Law 91 of 2005. The government announced that imposing tax on natural person’s income is an important tax policy to realize social justice about tax burden, in a manner that respects income levels and achieve justice and equality.

إحالة: حيث إن وقائع الدعوى الحاضرة وعناصرها ومستندات الخصوم ودفوعهم ودفاعهم فيها أحاط بها الحكمان السابق صدورهما من هذه المحكمة في جلسة 5/2/2014 وجلسة 6/8/2018 وحكمي محكمة النقض الذين سيرد ذكرهما، وتحيل المحكمة إلى مدونات هذه الأحكام معتبرة أسبابها مكملة لأسباب هذا الحكم ومتممة له، وبالطبع دون أن تتضمن هذه الإحالة التقديرات والحيثيات والدعامات والنتائج المتناقضة مع أسباب الحكم الحالي أو المعارضة لعماده. وعلى أية حال، وبكلمات موجزة وبالقدر الكافي لحمل المنطوق، تعرض المحكمة للعناصر الأساسية الآتية:
• باعتبار أن مصر هي دولة مقر التحكيم، فقد طعن الجانب الليبي على حكم التحكيم أمام هذه المحكمة بالدعوى الحالية طالبًا القضاء ببطلانه. وفي 5/2/2014، واستنادصا إلى أن الاتفاقية "الموحدة" لم تتكلم عن أي نظام إجرائي يؤدي إلى إبطال أحكام التحكيم الصادرة في نطاقها وتحت مظلتها، إذ إنها لم تذكر مصطلح أو لفظ البطلان هذا، لا من بعيد ولا من قريب، قضت المحكمة بعدم قبول الدعوى.

Renvoi : Attendu que les faits et les éléments du présent recours et les pièces, les arguments et les plaidoiries des parties en litige sont énoncés dans les deux arrêts rendus par la présente cour à l’audience du 05/02/2014 et celle du 06/08/2018, et par les deux arrêts de la cour de cassation cités infra. , et que la Cour se réfère aux notes desdits arrêts en considérant leurs motifs complémentaires et supplétives de ceux de la présente sentence, et certainement sans que ce renvoi inclut les estimations, les attendus, les appuis et les résultats contradictoires avec les motifs de la présente sentence ou opposant à son fondement. En tout cas, la Cour présente, brièvement et suffisamment pour rendre le prononcé, les éléments fondamentaux suivants :
• Étant donné que l’Égypte est l’État siège de l’arbitrage, la partie libyenne a interjeté le présent recours en annulation contre la sentence arbitrale auprès de cette Cour. Le 05/02/2014, eu égard à la Convention « unifiée » n’indiquant aucun système procédural annulant les sentences rendues dans son cadre et sous son égide; ne mentionnant de près ou de loin le terme ou le mot « annulation », la Cour a statué de rejeter le recours.
