English term

A herein

English to Spanish Law/Patents Patents
Hola,

Al final de una patente aparece la siguiente frase:

"The discussion of a herein is not an admission that it is prior art to the present invention".

Herein entiendo que significa "en el presente documento" pero no acabo de verle sentido en la frase anterior.

Gracias por vuestra ayuda.

Creo que tenéis toda la razón. Pienso que la sugerencia de Charles "a reference herein" es la opción correcta. Muchas gracias a los dos.

Good catch, Charles:

The discussion **of a reference herein** is not an admission that it is prior art to the present invention, especially any reference that may have a publication date after the priority date of this application.
Charles Davis May 22, 2018:
Falta una palabra Sí que hay una serie de textos en Internet que dicen esto mismo, como dice Taña; pero hay otros que contienen la misma secuencia con "a reference herein" en vez de "a herein":

"The discussion of a reference herein is not an admission that it is prior art to the present invention"

Como no tiene sentido sin "referencia" y sí tiene sentido con esta palabra, entiendo que la versión en la que se omite es una errata.

There are 6 hits for the phrase. I don´t see the sense of the phrase either, and highly suspect it is a Google translation. 1) The discussion of ***a herein*** is not an admission that it is prior art to the present invention. "The discussion herein" ... would make more sense; 2) I don´t understand "prior art" either.

I agree with you, it makes no sense to me!

agree Charles Davis : See discussion entry: word missing (I believe). "Prior art" is a technical patent term: https://www.merriam-webster.com/dictionary/prior art
