Hi. I'm translating Poder Especial from Spain, Girona. In the faculties it says:
"vender a favor de la persona o personas, naturales o jurídicas, que libremente elija, los derechos que les corresponden sobre la finca que se dirá, así como cualquier bien mueble, estipular el precio y condiciones, la forma de pago de presente, confesado o aplazado total o parcialmente y en tales casos aceptar toda clase de garantías personales y reales, incluso la hipotecaria y la condición resolutoria. Recibir en su día y caso..."

Language to be understood by anyone I find the phrase 'condición resolutoria' somewhat obscure and not easy to be understood by everyone. In this case it is clearly a guarantee as I found in the definitions. I struggle to have to translate obscure phrases from one language and find obscure translations into another language. Why cannot keep it simple?

El poder se otorga para una actividad futura que es vender derechos, seguramente mediante un contrato o acuerdo formalizado

Why can't you not use an explanation? A bit of a harsh approach to disagree because you explain an obscure phrase, I think :) How many times you have to explain things to your clients who have no clue of legal jargon.

condition defeasant

'We've had this one many times on ProZ'. In tnis context of '..garantías personales y reales, incluso la hipotecaria.. ', I think condition defeasant - namely defeating grant of the mortgage loan - works well, especially in conveyancing practic/se.

Otherwise, condition subsequent : West (vs. condition precedent) isa standard translation or - lest we forget in Scots Civil vs. English Common Law - a resolutive condition (vs. suspensive condition in Scots law).
Example sentence:

Fulfillment of a defeasant condition and termination of a contract of *financial pledge* (charge) on the fixed assets of significant value (66/2015).

1. A rendering void; an annulment. 2. a. The voiding of a contract or deed. b. A clause within a contract or deed providing for annulment.

neutral Stuart and Aida Nelson : but is it defeating? You might be right, but it's me trying to understand :). I did check in the glossary and search function and could only find one entry in Spanish for 'condición resolutaria - cancellation provision' which I'm not sure fits in here.

What's 'defeated' need not be spelt out though in context could be collateral security > 'garantías personales y reales, incluso la hipotecaria', besides which there may be a gulf between ProZ entries and practical legal usage.
