Yes, I totally agree with your 2 points, I also searched them combined before I submit the answer, and found the term used extensively in the Roman civil law, however:
1- it was also used in the Turkish modern civil law as google indicates.
2- it is also found in a reference shared by King Saud university.
faculty.ksu.edu.sa/dr.reda/Documents/%D9%85%D8%B5%D8%B7%D9%84%D8%AD%D8%A7%D8%AA/%D9%85%D8%B5%D8%B7%D9%84%D8%AD%D8%A7%D8%AA%20%D8%A7%D9%84%D8%A3%D8%B1%D8%A7%D8%B6%D9%89%20%D9%88%D8%A7%D9%84%D9%85%D8%B3%D8%A7%D8%AD%D8%A9.pdf

3- I first wanted to use the UN term for الولاية القضائية which is "jurisdiction"
http://unterm.un.org/DGAACS/unterm.nsf/WebView?SearchView&Qu...

However, I thought it is more related to international law. After your notes in the discussion above, I think "jurisdiction" is the right choice. What do you think? Thank you so much for your notes.

Thank you for your second note.

This case I believe "Dative tutelage" would be the one. Have you checked the reference from the KSU?

Also, there is "Under Sequestration"
http://www.almaany.com/home.php?language=arabic&word=تحت الح...

and if you googled the combined term, I think you will find it more relevant. Please advise. BTW, you are also helping me to determine the best search strategy as part of a training course I am designing, so I am not going to stop till you find the term, and I find the best way to reach it :)
Thanks

Asker: Thanks! I have two remarks: 1. Both words combined barely reach 160 results in Google, i.e. too limited usage; 2. I believe this is the Roman phrase of the English 'legal guardianship' > "Dative Tutelage, in Civil Law, the tutelage of a minor appointed by a magistrate." See: http://books.google.com.qa/books?id=_3QSAAAAIAAJ&lpg=RA1-PT508&ots=1eOkp1Rzcx&dq=Dative%20tutelage%20minor&hl=ar&pg=RA1-PT508#v=onepage&q=Dative%20tutelage&f=false

Asker: With all due respect Al-Maany, it doesn't elaborate. So it isn't helpful. It might help only as a starting point of search in case the researcher has no initial idea. The KSU document, i.e. regarding 'dative tutelage', is fine but irrelevant as I explained in my reply and the discussion. So far I am happy with "receivership". Thanks and good luck with designing the training course.

Asker: Regarding 'sequestration' I believe it goes as حجز and مصادرة that are different from وصاية or حراسة.

Asker: Thanks! However, I believe this has to do with child/minor custody, i.e. civil law. The context indicates issues related to contracting and bankruptcy.

Yes:

e.g.1: The D.C. Jail's medical care facility was placed under court-ordered receivership in August 1995, after the city was held in contempt for repeatedly failing to implement court orders.

e.g.2:The distribution business of Foucque Automobile, which was placed under court-ordered receivership on December 1, 2010, represented full-year revenue of about €40 million in 2009 for just over 1,400 new vehicles sold.

e.g.3: The city was on the brink of insolvency and had asked to be placed under judicial receivership when state leaders decided to prioritize payments to bondholders in the case of a Chapter 9 filing.

Hi Mr.Batiran
This is the term I usually use. Here we call the person "متصرّف قضائي", "a receiver "(English) and "Administrateur judiciaire" (french).
I have not checked any Arabic reference as at times they are misleading. Do they refer to the same thing?

Asker: Thanks! Could you provide references?

Asker: هل هذه حراسة قضائية أو وصاية قانونية؟ هل من ربط بالمقابل العربي؟ وشكراً

Asker: Thank you for your input! I am still trying to figure that out.
