I understand the concept, I just don't know how to put it by itself as a title. The paragraph says:Neither the company nor any of its affiliates will directly or indirectly permit or assist any third party to as an employee, employer, consultant....to call on, solicit, take away, or attempt to call on, solicit, or take away...etc.

Prohibicion de solicitar asociacion competitiva? This doesn't have much to do with my previous suggestion, in the light of the new context. How about this wording? Actually, Answer to the query term would now be the cognate 'solicitar' with the rest explained in the continued translation of the paragraph.

Rest of the paragraph says: XXX shall also not (a) entice, induce or in any manner influence any person or entity who is, or shall be in the direct or indirect service of XXX to leave the same for the purpose of engaging in a business or being employed by or associated with any other business; or (b) engage or participate in any business that is in competition in any manner whatsoever with the business of XXX

Do you see how important that part was? It is my opinion that, in the light of the answers proposed, the appropriate one is that suggested by Lozano and recently included in this section by Boulter. The rest are fine but my opinion is that they do not apply in this context; this is about unloyal actions in the course of one's job.

'Politica de Prohibicion contra Captacion Desleal Okay, now that we have some better Answers, I suggest this combination of terminology, for Discussion. To translate the paragraph that goes with it, I suggest breaking it into four (4)sentences, describing the 3 'who' that may not, the three 'whats' that they may not do under the 'policy', etc. It was common legaleze to put all that info into one sentence, but not necessary to translated as only one. Each thing mentioned there is a different aspect or issue that must be addressed. There is no repetition (in other terms of the same thing) in this sentence, as some lawyers like to do at times.

'no solicitar/importunar' or 'no pretender/procurar la comision de delito'

'Solicitation' has two main connotations in the context of law & business.
1- To request, pressure or trick another person into committing a crime. This includes prostitutes who may attempt to tempt someone into paying them to have sex with them in a jurisdiction where that is illegal; but it also includes businessmen who may bribe officials or company executives to violate ethics for profit.

2- A lawyer is prohibited by law, in most jurisdictions, from asking for work as a lawyer from another person. This includes face-to face contact with the intention of 'soliciting' paid legal work; it also includes entrapment or manipulation of a court proceeding in order to trap some person into needing his legal services, in order to survive or to avoid imprisonment for example. This is unethical in the special professional setting of lawyers.

I think that in the query context, the first connotation is the point and I suggest that you translate it 'no importunar por comision de delitos'. The other suggestions in my reply, 'pretender/solicitar' are for background and in case I don't really see the context of the query or my Spanish is faulty.

Since 'Prohibicion de solicitar asociacion competitiva' appears to fit Laura's context in this query, I now like very much Smartranslator's suggestion (below) of 'Clausula de Exclusividad'.

I recommend this over my own suggestion, both for concise wording and for its natural, official sound.

Si lo he entendido bien, se trata de una de las modalidades de competencia desleal.

A mí me suena más natural decir "prohibición de ..." en vez de "no ...".

agree Richard Boulter : I prefer 'clausula de exclusividad' rather than my own suggested translation in the context that we finally established for this Query term. It is more concise, more natural and much more likely to be what a native-speaking corporate lawyer would write.
