عقد غير محتفَظ بأصله Explanation: عقد غير محتفَظ بأصله بحث دكتوراه حول التوثيق http://biblio.univ-alger.dz/jspui/bitstream/1635/14166/1/ZAZ... صفحة 275 فالموثق يحرر نوعين من العقود، عقود يحتفظ بأصلها وتسمى أصولا حيث يسلم منها صورا تنفيذية أو نسخ، وهناك عقود لا يحتفظ بأصلها وهي عادة تكون أقل أهمية كالوكالات فبمجرد أن ينتهي الموثق من تحريرها يسلمها مباشرة للأطراف دون الاحتفاظ بأصلها المادة 37 من قانون التوثيق الجزائري يمسك الموثق فهرسا للعقود التي يتلقاها بما فيها تلك التي لا يحتفظ بأصلها، وسجلات أخرى ترقم ويؤشر عليها من قبل رئيس المحكمة التي يقع مكتبه بدائرة اختصاصها Le notaire tient un répertoire des actes qu'il reçoit, y compris ceux reçus en brevet, ainsi que des registres qui sont cotés et paraphés par le président du tribunal du lieu d'implantation de l'office notarial.   |
