Ewentualnie tak, jeśli musi być 'withdraw'
should either party/of them withdraw from entering into the agreement
Peer comment(s):

agree Polangmar : should either party/of them withdraw from entering into the agreement (refrain/abstain from entering into the agreement mogłoby być, ale już "refraining/abstaining party" raczej nie, więc trzeba ujednolicić słownictwo)

Dziękuję. W bliźniaczym pytaniu ma być 'the withdrawing party', więc autor pytania niech sam podejmie decyzję, co mu najlepiej pasuje.

in the event of withdrawal from the agreement

In another question we are talking about 'the withdrawing party'. Should we follow the terminology, parhaps we might need to use 'withdrawal' of 'withdrawing', but that is up to the context.

In the event of withdrawal from the agreement

"withdrawing from the conclusion of/signing the agreement" would sound long and strike as odd, but is more precise
Peer comment(s):

agree Polangmar : withdrawing from the conclusion of/signing the agreement (jeśli rzeczywiście "zawarcia", bo jest rozbieżność między nagłówkiem pytania a kontekstem)

a niektorzy nawet tak:
"If the bidder to whom the contract is awarded shall fail to enter into the contract as required, the council may declare the award to that bidder a nullity, and award"

samo "failure to enter into a contract" daje optymistyczne rezultaty guglowe :)
