Non résolutoire, c'est-à-dire qui n'entraîne pas la résolution pour inexécution. C'est un terme de droit qui est très éloigné de la notion d'évasion fiscale dont il n'est pas du tout question.

"En France, le principe existe, mais il n'est pas formalisé par un texte, sauf dans les conventions internationales où l'on parle de clause antiabus." Cela dit, le Senat français parle bien d'évitement et d'évasion:
