Vorzugspfandrecht

German to English Law/Patents Real Estate Condominium Act (Austrian)
Can anyone help with this term? I'm at a loss!!! It's in a section from a management agreement for an administrator of a condiminium and how fees arising from assertion of the Vorzugspfandrecht in § 27 c of the Condominium Act (Wohnungseigentumsgesetz) are handled. If anyone can help I would very much appreciate it!

I've just cobbled this together from my real estate dico. Not sure if it's the best translation for your context.

neutral Andras Malatinszky : Prior lien is wrong, I'm afraid: the point is precisely that the law gives certain entities (such as the local tax authority or perhaps the condo association) first lien position even if someone else (typically a bank) already has a prior lien.

I didn't suggest prior lien, I suggested preferential lien.

the opposite is called subordinated lien position

As this overrides both secured and preferred debts, then maybe pre-preferential - like the Inland Rev. and local authority council tax - is a better epithet.

Whether protected by a lien or charge depends on the nature of interest it attaches to.
